His pledge to direct Justice Department investigations is backed by allies who view his second term as driven by a maximalist theory of a president’s authority. But it also underscores why a second Trump term would be dramatically different. Some in Washington saw them as guardrails for a White House intent on fracturing not one, but all three branches of government. Yet Trump, should he secure a second term, would enter the White House with his most powerful Republican critics on Capitol Hill almost all gone. That would be a position that isn’t backed by his second term policy plans, or his private impulses during his first term in office – or, for that matter, in the decades prior.

A few hours before the interview was set to begin, the agents were startled to hear that the Justice Department was telling them to cancel the long-planned meeting. The interview was never rescheduled, and the investigation would limp along for another few years before culminating, in late 2022, with a victory for Caterpillar. The criminal investigation was closed without charges being filed — and even without agents having the chance to review records seized from the company. Caterpillar appears to have defused the investigation at least in part by deploying a type of raw legal power that rarely becomes publicly visible. DeSantis has appointed far more extreme justices to the Florida Supreme Court than Trump did to the US Supreme Court. But DeSantis’ appointees to the Florida Supreme Court embrace the Thomas-Alito wing of the organization. DeSantis’ appointees, in contrast, have jumped at entrenching conservative electoral domination and curtailing Black political power. Imitating Thomas and Alito, DeSantis’ appointees have rushed into gratuitous political controversies, writing opinions heavy on theory and light on practicality. Thomas and Alito are in this vanguard, as are DeSantis’ appointees and some of Trump’s lower court appointees, with which DeSantis is aligned.

But it’s inadequate to describe why affirmative action is in danger. Affirmative action dates from executive orders issued by Presidents John F. Kennedy and Lyndon Johnson in the 1960s. Giving a break to a few Black students might have meant denying a chance to the equivalent number of white students. But because white people constituted an overwhelming majority, the number of white applicants disadvantaged by affirmative action was relatively low. And advantages were being redistributed from descendants of the former oppressor race (white people) to descendants of the former oppressed race (Black people).
